USER AGREEMENT - TERMS AND CONDITIONS
1.1 Binding Terms and Conditions
Registering for an account and/or participating at any Virtual Sports, Inc. owned web sites signifies your knowledge and agreement of this user agreement and the terms and conditions contained herein. Virtual Sports, Inc. may modify the terms and conditions at any time and your continued use of the site following such modifications signifies your acceptance of the modifications. It is the sole responsibility of the user to review these terms and conditions periodically for any modifications.
1.2 Entire Agreement
The terms and conditions herein in connection with any other rules or obligations detailed on any Virtual Sports, Inc. web site consitute the entire agreement between any user and Virtual Sports, Inc. and cannot be modified by any user. The terms and conditions cannot be modified on an individual basis by any person affiliated or claiming affiliation with Virtual Sports, Inc. Nothing prevents Virtual Sports, Inc. from modifying the terms and conditions and posting such modifications.
1.3 Governing Law and Disputes
The terms and conditions will be governed and construed in accordance with the US laws of the physical state of residence of Virtual Sports, Inc. irrespective of any principles of conflicts of law. By registering and/or particiating you agree that any dispute that cannot be resolved between parties shall be resolved individually without resort to any form of class action. You further agree that any legal action arising from any dispute shall proceed only in the state or federal courts of the physical residence of the headquarters of Virtual Sports, Inc. only.
1.4 Severability
If any portion of these terms and conditions is deemed void then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of the remaining provisions.
2.1 United States Eligibility
To open an account and/or participate with Virtual Sports, Inc. unless otherwise noted inside of a game you must:
a) be a natural person assigned to the e-mail address submitted on your account and be at least 13 years old;
b) be a U.S. citizen or resident alien with a U.S. address;
c) be physically located within the U.S.;
d) be physically located in a U.S. state in which participation on the site is not prohibited.
The rules governing skill-based contests with entry fees and/or prizes are set up by each individual state and not by the federal government. Based on the 50 sets of laws, prizes are not available to residents of: Iowa, Maryland, or Vermont.
Void where prohibited or restricted by law.
2.2 Non-U.S. Eligibility - Anything other than the 50 states of the U.S.
To open an account and/or participate at Virtual Sports, Inc. unless otherwise noted inside of a game you must:
a) be a natural person assigned to the e-mail address submitted on your account and be at least 13 years old;
b) be legally qualified to participate from the physically located place of residence and participation.
Void where prohibited or restricted by law.
Prizes are not available to citizens outside of the United States.
2.3 Additional Persons Not Eligible
Virtual Sports, Inc. employees or any other person with knowledge of the inner-workings or algorithms used on the Virtual Sports, Inc. site are not eligible to win prizes in the game.
2.4 Legality
Anyone registering and/or participating at Virtual Sports, Inc. is subject and responsible for all laws of the state, province, and/or country in which they reside or access Virtual Sports, Inc. from and are solely responsible for obeying those laws. You agree Virtual Sports, Inc. cannot be held liable if laws applicable to you restrict or prohibit participation. Virtual Sports, Inc. makes no respresentations or warranties implicit or explicit as to your legal right to participate at Virtual Sports, Inc..
2.5 Monitoring
Virtual Sports, Inc. reserves the right to monitor the location of anyone registering and/or participating at Virtual Sports, Inc.. Virtual Sports, Inc. reserves the right to block access from any jurisiction in which participation is illegal or restricted.
2.6 Additional Information
Virtual Sports, Inc. has the right to request additional information at any time, some of which may be private, from any user as deemed necessary by Virtual Sports, Inc. Participant will have 3 business days to provide any information requested by Virtual Sports, Inc. and if it is not provided by participant within 3 business days it can result in cancellation of participants account and loss of anything of value in participant's account at Virtual Sports, Inc.
2.7 Acknowledgement of Proprietary Rights
Virtual-Sports.com is the property of Virtual Sports, Inc. with corporate headquarters located at 11130 Kingston Pike, Suite 1-255, Knoxville, TN 37934 and by registering and/or participating you agree that all information contained on Virtual-Sports.com may be protected in all forms and media by one or more valid copyrights, patents, trademarks, trade secrets, or other proprietary rights, and all rights are owned by Virtual Sports, Inc.
2.8 Other Rights
Virtual Sports, Inc. neither warrants nor represents that your use of materials displayed on Virtual Sports, Inc. will not infringe rights of third parties.
2.9 Accuracy of Information
Virtual Sports, Inc. makes no warranties or representations as to the accuracy or timeliness of any information dispayed on the site. Virtual Sports, Inc. assumes no liability or responsiblity for any errors or omissions in the content of the site.
2.10 Accessibility of Site
Virtual Sports, Inc. shall not be liable and makes no warranties or representations as to the ability to access the site at any time. Virtual Sports, Inc. can not be held liable for the inability of any participant to access the site regardless of where the problem is located at.
2.11 Modification or Discontinuation of Service
Virtual Sports, Inc. reserves the right to modify or discontinue the game at any time and Virtual Sports, Inc. shall not be held liable to any member or third party for any loss or damage.
3.1 Partipant Responsibility
It is the responsiblity of the participant to adhere to all rules and conditions outlined in the game. This includes but is not limited to anything deemed to be cheating or not in the best interest of the game. Virtual Sports, Inc. reserves the right to cancel a participants account at any time for anything Virtual Sports, Inc. determines to not be in the best interest of the game and cancellation can result in loss of anything of value in the game. Virtual Sports, Inc. reserves the right to confiscate anything of value or not of value from any user who obtained those things by any means outside the rules outlined in the game.
3.2 Response to Questions, Postings, or Any Other Issues
Virtual Sports, Inc. always trys to respond to questions, postings, or any other issues in a timely manner but Virtual Sports, Inc. can not be held liable for speed of response to any question, posting, or issue.
3.3 Forums and Other Particpant Text
Profanity, inappropriate language, or any other language not in the best interest of the game is strictly prohibited anywhere on the site and can lead to immediate cancellation of a participant's account including loss of anything of value at Virtual Sports, Inc web sites.
3.4 Views, Opinions, and Postings of Partipants
Views, opinions, and any other postings on Virtual Sports, Inc. of participants are not necessarily the views or supported by Virtual Sports, Inc. and Virtual Sports, Inc. can not be held liable for any such views, opinions, or postings.
3.5 Fees
All fees associated with this game are for entertainment value only. Fees are for supplementing costs involved in operating any Virtual Sports, Inc. site and are not put towards any prizes offered on any Virtual Sports, Inc. site.
3.6 Termination Due to Inactivity
Participants not logging in for a period of 1 year can have their accounts deactivated and anything contained in their accounts becomes the property of Virtual Sports, Inc. Accounts can not be reactivated.
3.7 Refund Policy
Participants have 14 days from their first payment to close their account and request a full refund. After 14 days from a participant's first payment to Virtual Sports, Inc. only credits still remaining in a participant's account can be refunded.
